Musk vs. OpenAI: The Trial That Was Always Coming

The trial between Elon Musk and OpenAI is officially here. And yeah, it’s going to be a mess.

We’re talking about two of the most egotistical people in tech going head-to-head over who deserves credit — and cash — for the early days of AI. Over the next few weeks, expect a lot of important people’s dirty laundry to get aired in public. Which, honestly, might be exactly what Musk wants.

This isn’t some dry legal dispute about contracts. It’s personal. Musk was an early investor and co-founder of OpenAI, back when it was a nonprofit with big ideals. Then Altman took it commercial, Musk left, and the grudge festered. Now Musk is suing, claiming OpenAI abandoned its mission and that he’s owed something for his early contributions.

The Verge’s Liz Lopatto breaks down the origins of the case, how it got to trial, and why this is going to be a circus. The transcript of the Vergecast episode is worth a listen if you want the full backstory.

What’s interesting is that Musk isn’t just after money. He’s after reputation. He wants to paint Altman and OpenAI as hypocrites who sold out the nonprofit dream for profit. And he’s willing to drag everyone — including Microsoft, which has deep ties to OpenAI — into the mud.

OpenAI’s defense will likely be that Musk knew the deal, that he was fine with the for-profit pivot until he wasn’t, and that he’s just bitter about not being in control. Both sides have a point, and neither looks great.

The real loser here might be the public. We’ll get a front-row seat to the messy, petty, and often unflattering reality of how AI’s biggest players operate. But we probably won’t get any clarity on who actually “owns” the AI revolution. That’s not how these things work.

Strap in. This is going to be a long, noisy trial.
